Real Property Law

Foreign companies require clearance from the RBI before acquiring
property in India except where they wish to lease property for a term of
five years or less.
An important hurdle directly affecting the transfer of property in
India is section 269 of the Income Tax Act, 1961, which gives pre-emptive
right to the Government to purchase, among others, properties exceeding
Rs. 7,500,000 (approx. US $163,576, GBP 92,363) in value from the owner of
the property, in the event that the Government concludes that the property
has been undervalued. To deal with this enactment and to also minimise the
effect of stamp duty payable on most transfers of property, several
innovations and permissible forms of documentation can be adopted. We
